TEMPLATE — NOT LEGAL ADVICE. This document is a starting draft tailored to Kiddos. A licensed attorney in your jurisdiction must review, customize, and approve it before you publish or rely on it. Replace every [bracketed] placeholder. Pay special attention to the arbitration, liability, children's data, and SMS sections, which have state- and country-specific requirements.
Company: [Company legal name] ("Kiddos," "we," "us," "our") Service: the Kiddos website, apps, and related services (the "Service").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use Kiddos
You must be at least 18 years old and legally able to enter a contract. You may create an account for a child only if you are that child's parent or legal guardian and you have the authority to consent to the child's use and to the processing of their information (see Section 11 and our Privacy Policy). You are responsible for all activity under your account and for keeping your password secure.
2. What Kiddos is — and is not
Kiddos is a communication and coordination tool for co-parents. Kiddos is not a law firm, attorney, mediator, arbitrator, therapist, or emergency service. It does not provide legal, financial, medical, or mental-health advice. Information in the Service, including any "legal library" or "know your rights" content, is general information only, may not reflect current law in your jurisdiction, and is not a substitute for advice from a licensed professional. Using Kiddos does not create an attorney-client relationship with us. We are a neutral platform and are not a party to any dispute, agreement, or court matter between you and your co-parent.
3. Your account and the two-parent model
A "family" on Kiddos may include two parents, children, and approved members of a trusted circle. Each adult controls their own account and settings; you cannot change another adult's settings. Inviting a co-parent or other person gives them access as described in the Service; you are responsible for whom you invite.
4. Acceptable use
You agree not to:
- harass, threaten, stalk, abuse, defame, or intimidate anyone;
- use the Service to violate a court order, protective order, or custody order;
- upload unlawful, infringing, or harmful content, or content sexualizing or endangering a minor;
- attempt to access another person's account or data without authorization;
- scrape, reverse-engineer, disrupt, or overload the Service; or
- use the Service for any unlawful purpose. We may suspend or terminate accounts that violate these Terms or our Safety Policy, and we may remove content or cooperate with law enforcement as described in our Safety and Privacy Policies.
5. User content and the on-the-record record
You retain ownership of the content you submit (messages, schedules, expenses, documents, photos, and videos). You grant Kiddos a limited license to host, process, display, and transmit that content to operate the Service. Messages and certain records are designed to be tamper-evident and may not be editable or deletable, so that both parents (and, where applicable, a court) can rely on a neutral record. You are responsible for the content you submit and for having the rights to submit it.
6. AI features
Kiddos uses artificial intelligence (including third-party AI providers) to offer features such as tone suggestions and summaries. AI output may be inaccurate or incomplete, is a suggestion only, and is not advice. You decide what to send. AI features never require you to concede on a safety concern. By using AI features, you understand that relevant content is processed by our AI providers to generate output (see Privacy Policy).
7. Text messages (SMS)
If you verify a mobile number and opt in, you consent to receive recurring transactional text messages (alerts, reminders, codes) from Kiddos at that number. Message and data rates may apply. Reply STOP to opt out and HELP for help. Consent to texts is not a condition of purchase. Carrier terms apply, and we are not liable for delayed or undelivered messages.
8. Subscriptions, payments, and refunds
Paid plans are billed through our payment processor ([Stripe]) on a recurring basis (monthly or annual) until cancelled. By subscribing, you authorize recurring charges. You can cancel anytime; cancellation stops future renewals and takes effect at the end of the current period. [Refund policy — e.g., prorated or no refunds for partial periods; state your actual policy here.] Prices and features may change with notice as permitted by law.
9. Third-party services
The Service relies on third parties (e.g., hosting, SMS, payments, AI, email). We are not responsible for third-party services, and your use of them may be subject to their terms.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, that any record will be admissible in any proceeding, or that AI output will be accurate.
11. Children
A parent/guardian who creates a child account is responsible for that child's use, represents that they have authority to consent, and agrees to our handling of the child's information as described in the Privacy Policy. We do not direct advertising to children and do not sell children's personal information.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIDDOS AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF [amount, e.g., $100] OR THE AMOUNTS YOU PAID US IN THE [12] MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13. Indemnification
You will indemnify and hold Kiddos harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or the rights of others, to the extent permitted by law.
14. Dispute resolution
[Choose and have counsel finalize: informal resolution first; then binding arbitration on an individual basis with a class-action waiver, OR court jurisdiction. Include any required consumer-arbitration disclosures and opt-out.] These Terms are governed by the laws of [State/Country], without regard to conflict-of-laws rules.
15. Changes and termination
We may update these Terms; material changes will be notified as required by law, and continued use means acceptance. You may stop using the Service at any time. We may suspend or terminate access for violations or to protect users.
